UGSOA and Desiree Sullivan Continue to Spread Lies

Ladies and Gentlemen,
I do hope you have received the flawed letter from Ms Sullivan and her anonymous enclosed color hand out with all the writing highlighted in yellow. Ms Sullivan and her minions probably spent two bucks plus a full 44 cents to mail you hopeless propaganda. Let me deal with the letter and it's attack on me and Mr Guy James. The NLRB in region 16 in a case UGSOA is losing and should be announced soon merely found that FCGOA is a new Union. That was an admission made in front of the Board. Guy James and the FCGOA have won elections and are filing and fighting on these issues daily.
Guy left a broader Labor movement to start a new 9(b)(3) International Union after twenty years of organizing and negotiating. He rose in prominence and responsibility over that time. There are too many shady guard unions, some even worse than the UGSOA. A true Labor professional is what this game has needed for a long time, the paradigm has shifted with Guy James on the scene.
The offices of FCGOA are contracted out as standby offices in modern buildings all in centers of power and equipped with videoconferencing and the latest technology to reach people. The DC office is about two blocks from the White House. I could schedule a meeting at our DC office with minimal waiting time, the office is on standby. Unlike Ms Sullivan's organization stuffed into a strip mall on an outskirt of Denver Colorado, any of our meetings would be in a professional setting across from a Metro Stop.
I hope your letter had an attachment showing that I was removed for cause from the UGSOA mine didn't but I am happy to share the tale of the Evil Ron Mikell so pull up your rocking chair,
Once upon a time in Portland Oregon a fellow came to work as a GSA Guard for a company called Gabriel Security, it was in late November of 1998. The folks there were starting a Union but no one told me and they had a meeting on 12/18/1998 and established Local 38 UGSOA. The fellow who came to town was Ron Mikell.
The first three guys running the Union were Gary Eaton,President, Bryce Davis VP and Shawn Coverdell, Secretary Treasurer. The first thing that happened with this new Union is all the officers got fired because when the Christmas check came it bounced like a "super ball". The Union officers complained to the Government's Contracting Officer who felt like that shouldn't happen, whining employees bothering the government person. Gabriel violated the law when they fired the three officers for "breaking the chain of command." The International said go to NLRB, they provided no help directly to the Union Officers. The Board issued a complaint(essentially a Labor indictment) and took Gabriel in front of an ALJ that ruled in favor of Eaton et al and ordered reinstatement, back-pay and interest.
Gabriel was a small start-up run by a naturalized Nigerian that always seemed to be in Nigeria and unavailable when we needed coats that were suitable for something other than a South Florida winter.. He bounced checks again and the second complaint Eaton,Davis and Coverdell made went to the Comptroller of the currency and the President of a Miami bank that had said the error was a bank error.
The checks were made good and the Miami area Bank Vice-President who claimed it was a bank error was fired. I saw the letter from the Bank. Gabriel Security was replaced by Seattle Security, the evil Ron Mikell replaced Shawn Coverdell and Coverdell went on to replace Bryce Davis as VP. Seattle Security did sign a CBA but then faxed a letter in on the day it went into effect November 1,2000 saying they could not afford it so they were backing out. We picketed the Portland federal Building and handed out literature to employees, Seattle Security rethought their position. Seattle Security bailed on Super Bowl weekend January 2001 and were replaced by Argus Security. There was never any UGSOA International help in any of this.
We began negotiations with Sheila Leslie of Argus Security after we settled charges against her and Argus. Argus took the position that they were an emergency temporary company and that they would talk to the Union "in a few months" but would "not discuss wages". That was the first meeting with them, I filed CA charges with the NLRB the next day. The International Union provided no help.
A big fight developed between me and Gary Eaton who had begun to think of the presidency as his forever. He forced my hand so I forced a Trusteeship which was ended with new elections for shorter terms and an expanded board with new by-laws. I was elected President in 2001 and again in 2003. The International ran the trusteeship or rather a fellow named Jerry Smith a night guard at the Seattle Court ran it for the International.
Sheila Leslie came to town and the E-Board of Local 38 and James Carney met at the Silver cloud Inn at the Portland Airport. We came to agreement signed everything and said goodbye, Sheila caught a plane and we had lunch with James. We paid for that as I recall along with the conference room. UGSOA bought Carney's ticket to Portland
Sheila Leslie calls Carney after we finished and says that the unit is too big ,some south Oregon guards object and she will not go through with the CBA if he doesn't agree to slice off the southern half of the Unit about half of the State of Oregon. Vissar and Carney do not even call us, Carney agrees and signs a modification. Because of that modification we had to conduct a long campaign, elections to include post-election hearing and briefs and because the whole thing started before and finished just 9/11, I had to endure being called unpatriotic because I insisted on our rights.
The International never helped, in fact they reimbursed no costs for something Carney was the prime author of. Local 38 got a contract with Argus and then sought another Unit when the attacks of 9/11 led to security officers on the dams of the Columbia and Snake Rivers. Argus had that work so we went to them and their managers Chad Withrow and Craig Schweigert said there would never be a Union on the Dams. We promptly organized one, stretching from Portland Oregon to Idaho. We finally got a CBA with no help from the International. We added guards at Longview and Vancouver Washington and Tacoma Washington. By 2003 we had six units under contract and were still growing Local 38, it was the best run local in the UGSOA and unit leaders like Paul Bond,Randy Martz, Dave Alpaugh and Joe Whitely were better than any of the Presidents in the UGSOA system.
It was apparent to me by this time that the UGSOA International Union is not much more than a sponge soaking up their per capita tax of one hour of pay per month. They had given us nothing and when Wackenhut replaced Argus in 2002 we did not even let them come to negotiations. I had been made a deputy regional director in early 2001 and I went with the fellow I trained ,Dave Coon of Eugene Oregon, to San Diego to help a particularly inept Chapter President named Mike Hough. Mike had only himself as a member so he made himself President. The international bought me a plane ticket and eventually Local 38 loaned local 52 (Hough's Local) 2000 dollars for postage and such. Mike Hough is now in charge of the FED Division of the UGSOA, I hope they have budgeted someone to tie his shoes. Dave Coon came to DC to help with Local 43 in DC which was always in trouble.
Local 52 (San Diego) did pay the 2000 dollars back and it was listed on our LM report. I wrote many articles for the infrequently published UGSOA newsletter but they were always rejected by Vissar. I represented the International union as Lead Counsel in cases in Seattle and Detroit facing off against some pretty weighty opponents. The International paid my airfare and my food and hotel bill. I got 50 dollars a day for two days in Detroit. I got mileage for a trip to Seattle.
I was made an international Director and seated on the Big board with a six month probation that expired in the fall of 2003. I sought out other members of the International board including Ava Ramey of DC just removed this summer as President of Local 80. There being a requirement that the Board meet every six months, I asked what happened at the last meeting. Ava Ramey told me in 2003 that she had been on the Board six years and there had been no meetings. I forced a meeting that was held by phone in 2003 on the Wednesday before Thanksgiving. I got through three points as motions over the objections of Vissar and Carney. The first was for an in-person meeting of the big Board. The second was for a special convention to pass a realignment to a more regional basis for the organization. The last was most important, Vissar had implemented a policy to stick locals with half of the arbitration cost. My motion passed 6-3 making all costs of Arbitration an International expenses.
The next week I got a letter thanking me for my service on the International Board and dismissing me from the Board. My dismissal from the International Board was followed by a letter from Vissar saying "I am the Captain of the Ship" and I veto the actions of the International Executive Board. I pointed out and continued to point out that the Board had to meet every six months, they had the power to remove the President and that there were no veto authorities in the Constitution passed by the 2000 convention. My Local was placed in trusteeship when I continued to protest the unlawful actions of the International President.
There was at the time a very serious case against The Wackenhut Corporation in arbitration, the case was Poage,Febus and Wetzel and it started on 9/3/2003 when three guys were removed by the government and fired without just cause. Three others were disciplined but my investigation found one guilty and his punishment light. It took five years to complete that case and win big money for Poage , Febus and Wetzel. Ron Miley was on the case and he got a days pay with five years worth of 9 per cent interest. I saw him last month and I still have Mike Wetzel's email address. I can give you Miley's work number in Portland.. This case was vital to the cause and it was even cited in the arbitrator's judgement in Jenkins (Local 44) V WSI.
I told Carney I would drop my complaint if local 38 was restored from what over the years came to be called Trusteeship I. This "trusteeship" had no hearing and closed in less than three weeks. There were NLRB charges filed against the Local for violation of the duty of fair representation during the trusteeship but rather than defend against them, the International fostered them. The International wanted changes to by-laws in Local 38 that were not in the opinion of the Board in the best interests of the members.
At the next meeting of the local union held at the Operating Engineers Local hall off of I-205 in Milwaukie Oregon, the body authorized the Executive Board to seek a new International. I consulted with the other units in meetings held in the Columbia plateau and up and down I-5. The group in Portland wanted to dump the UGSOA. Everyone else knew nothing of the International Union which had given us no help only trouble. To the guys in the hinterland, me and the guys I trained were the Union. The local 38 board authorized me a trip to meet with the SPFPA E-Board which was meeting in Las Vegas and affiliate with SPFPA. When we were accepted, I returned to Portland and faxed our change to Denver.
The next day I received a fax from Denver saying we were in trusteeship again in what I now refer to as Trusteeship II. We made a move to resist this trusteeship and an attempt was made to say I had absconded with money when the Local 38 board authorized me to deposit 7500 dollars with our lawyer Giles Gibson for arbitration costs and in case we needed to fight the international UGSOA. The International Union tried to bring some former officers back to their resigned positions to say that the authorizing chapter officers were just my yes men.
The gamble was that the International would let us go, we were unhappy and wanted a clean exit. That did not prove to be the case, they had Jerry Smith come to town and take our 30,000 dollar nest egg using it eventually to hire lawyers to sue me and the rest of the Board in US District Court. They launched their lawsuit even after we had surrendered. Our consultation with the lawyer led us to believe that our fight against trusteeship was hopeless. The more important thing was that the Poage Febus and Wetzel case had to go forward no matter what happened to us .
UGSOA had us served the summons and complaint at the Trusteeship Hearing presided over by Ron Smith, a guy serving as VP in a job I had turned down a year before. Ron Smith was later sued by UGSOA and in that summons and complaint in the court of Colorado, the UGSOA mentions that same 7500 dollars which Giles Gibson remitted as a check off of his trust account. They seem to sound as if they believe in the Colorado filing that Smith and I ran off with the money.
The lawsuit against me languished in the US District Court in Oregon, I defended and paid for all three of us. There was me, Dave Libbrecht and David Alpaugh. Alpaugh was dropped. I was offered a way out of the lawsuit if I testified that SPFPA had fostered our rebellion. It was not true so I told them to go to hell when they repeated their suggestion. They sued SPFPA on the same issue but dropped it. The stupid lawsuit rocked along and we bandied back and forth on settling the suit. I agreed to resign as a member, President and a member of the International Executive Board stay out of a UGSOA Local until July 2010. I agreed to take no position in a 9(b)(3) union for two years I agreed to pay back to the Local the funds authorized by the Local 38 Board to make the trip to Vegas and give up my Beck rights as an Objector. I agreed to say that the local was placed in trusteeship because of actions I took. I became the evil Ron Mikell as far as the UGSOA was concerned
It was more important to take care of members Poage, Febus and Wetzel than to worry how UGSOA would spin things and UGSOA was trying to avoid their responsibility for this grievance and they did eventually tire of funding it. The attorney finished on a contingency basis after UGSOA stopped funding it.
The UGSOA stalled all through 2004 and early 2005. I told them to settle the lawsuit against me or I would attend the 2005 convention seek the Presidency of the UGSOA International and the removal of the whole Board of UGSOA and force a vote on the revocation of the trusteeship. The settlement was done in a week.
I stayed out of the Union stuff doing readings and monitoring the web-sites of UGSOA and SPFPA over the years. My wife took a job in the NCR so I got a job as a JPSO. Ernie Standiford at MVM knew me when he was the ATF ASAC in Savannah and I was a narcotics officer in South Georgia. Ask Ernie about Michael Oscar Morrison DOB 03/15/57 my premier Federal narcotics case..
I was invited to attend a Local 44 meeting in June 2007 where I explained that according to the UGSOA I was the evil Ron Mikell and although I could not be a member I would pay my fees equivalent to full dues and ask for no accounting. I explained I felt everyone should support the collective effort with their dues. I did say that I would pay my dues quarterly and in advance, that was refused by Harsley and in a vote that died for the lack of a second.
I decided to pay nothing although I did offer advice for the improvement of the 2004-2007 CBA in the 2007-2010 edition. It really has some crappy provisions especially as it comes to job security issues. A year went by and Harsley said the International President James Carney said I could be in the Local just not serve as an officer. I joined , paid dues and offered my help to redraw the flawed Local by-laws.
I did this for several months working with Keith Albury and members of the ICE unit in meetings held at my apartment complex. I asked for certain information and Harsley threw me out of Local 44 and got Carney to throw me out of the International,again. I think I have the distinction of being the only guy thrown out of the UGSOA on both coasts. It is a rare honor.
I have burdened you with this long letter because of Ms Sullivan's epistle where I am alleged to be "incapable of making sound and/or right decisions on your behalf." Ms Sullivan is making what are referred to as ad hominem arguments when she attacks me and Guy James rather than arguing in favor of the retention of the Incumbent.
I won't do that, instead Guy and I will take her and Mr Harsley to school on Labor 101 at the hearings in front of the NLRB next week. The "achievements" Ms Sullivan publishes in her letter typed 7/72010,postmarked 7/15/2010 and which arrived at my home 7/17/2010 are pretty questionable.
The Local Union launched by Scott Moody and a few other founding fathers achieved the entire JPSO pay scale up from Guard II without the UGSOA Local or the International. That was luck and perseverance by Scott Moody and others. That alone almost doubled the pay when the folks were sworn as SDUSM.,The rest of her 81.5 per cent bumps are annual increases on successive contracts.
I don't call inauguration day every four years an extra holiday. Desiree has never tried to get around DC on Inauguration Day. I am happy there is a shift differential, but I would prefer a break on parking or a transit benefit that helps everyone rather than just the guys that get to park free(night shift officers). The RC election gives us the right to bargain collectively as does 29 USC 157. The Grievance Procedure is crap and after three years, I have yet to see anything resembling fair and equal treatment in the workplace.
Letters attacking me don't matter I have had real enemies and lightweight dilettantes in hollowed out hovels in Denver concern me almost as much as a fellow that runs around whispering at corners like Mr Harsley describing me and my exploits. I am not trying to make decisions on your behalf like Ms Sullivan alleges. No, your committee has worked very hard to give you a choice in the upcoming election. The decision has always been and always should be yours. For way too long, decisions have been imposed upon you
I have included the UGSOA International LM-2 report filed late this year. That was probably necessary when long time leader James Carney bailed just before the May convention to become a company labor consultant.

Local 44 has routinely filed late under the Harsley regime. I looked for certain policies when I was on the By-laws committee.I found no 'Loss time policy" for payments made to Harsley or Lewis. I never did find. the policy where the body had authorized them to rebate dues to Local officers. I am certain that they remain in violation for many of the things cited in their last OLMS audit for which they were sanctioned. That doesn't mean they are crooked merely sloppy.
